On December 22, 2020, the ALS Disability Insurance Access Act of 2019 became law (Pub. L. 116-250). This eliminated the five-month waiting period for disability insurance benefits (DIB) for those with ALS who file a disability claim on or after December 23, 2020.
On March 23, the President signed into law a technical amendment to the ALS Disability Insurance Access Act of 2019 (Pub. L. 117-3), which makes the elimination of the five-month waiting period applicable to DIB claims based on ALS that are approved on or after July 23, 2020, regardless of when the claim was filed.
This means that any individual with ALS that has a Notice of Award on or after 7/23/2020 will now be paid for their 5 month waiting period.
